In your e-mail and comments you have asked me for the truth concerning the events surrounding Farrah's tribute the story behind the scences with Ryan and Alana. I met Craig Nevius on the set with William Shanter years ago, when I adjusted his horses and then him in the barn. Mr. Shatner is just a great and funny manm true professional. Craig has gone to alot of trouble, I expect Ryan has threatened him or tried to intimidate him and god know what that other had has done. But read his story, give it respect, absorb, embrace and keep it in your heart. Craig is doing an amazing thing, he is to be congratulated for his strength getting the truth out. I can only imagine what Ryan and Alana think of this.

Mr. HitmanPR, would you keep tabs on the Nevius case and keep us informed of events and perhaps show us the court documents filed in the case so we can see what evidence and legal arguments are being made by the parties in the case, please?
It seems to be in preliminary motion phase.
At least one of the 3 defendants has filed an answer to Nevius' complaint.

It's somewhat confusing as to the current status of the case.

ReplyDeleteI've been following Farrah's cancer for a while. At one point I was taping the "Celeb Gossip Shows" then fast forwarding through them to see if something was on. This was when Craigs piece came on. After that, I went to You Tube.
At one point, I caught wind of the lawsuit; it floored me. I could not understand why he was being cut out; well I could, but I didn't want to believe it at the time.
I think it sucks that Ryan appeared to have his own agenda; but then again, there is always one that does. I was never a fan of Ryan's but after seeing what was shown as "Farrah's Story" I gave him the benefit of the doubt. We all know what happened after that; people being kept out of her funeral service, the Vanity Fair article was disgusting. Then there is her son.

Craig - I've been in his shoes. You get on this mission to speak for the deceased. They aren't here any more, so someone needs to make sure their wishes were followed...
From my experience, Craig is going to spend a lot of money. They all are going to spend a lot of money, and in the end no one is going to "win"
I do hope Craig at least comes out of it with the rights to redo Wing & A Prayer the way she envisioned it. I feel Craig is an honest guy, the article was well done and from his heart. I have to say that of what I've read about Farrah since her passing, Craig was the only one that did her justice.

And Lana with the Entertainment Tonight wheelchair photo's always struck me as odd,Why would she even give that show interviews after they showed those photos that FARRAH NEVER WANTED SEEN???? I really wonder if Lana tipped the paparazzi off to when Farrah would arrive in LA from Gremany that day.I don't trust that woman and her comment in her book that a she has no intrest in a millionaire but instead wants a billionaire shows she's a money hungry bitch that cares only about $$$$$ and that's her main goal,it's not Farrah and it's not cancer she using those two subjects for her own financial agenda.

I do think that Nevius has a strong case of intentional tort by Francis and O'Neal.
ReplyDeleteWhat I wonder about is that arbitration clause in the 2008 SBR Agreement.
Since these are torts by, in essence, third parties, rather than contract breaches by first parties, then perhaps the arbitration clause is irrelevant, since Francis never really had any bonafide SBR authority in the first place.
We'll have to see how the court interprets the 2008 SBR agreement.
I wonder if there's some 'LLC' body of law that allows the 'appointment of CEO' scheme concocted by Francis and O'Neal and their lawyers to get around the assignment of Manager rights and responsibilities to Nevius in the event of FF being incapacitated in the 2008 SBR agreement.
The 'appointment of CEO' document was allgedly signed by supposedly a coherent FF on April 20, 2009, who then immediately was on her death bed, such that Dr. Piro wrote to the LA court/sheriff to let Redmond have a final death bed visit, which happened 5 days later on April 25, 2009.
Hmmm?
What Francis and O'Neal should have done was get FF to fire Nevius by exercising the Voluntary Termination (of SBR) clause in the 2008 SBR agreement and then form a new partnership with FF, rather than doing the tortious interference with Nevius and SBR which they did.

This is a contingency case,looks like.
Nevius is suing for attorneys fees as well, so I assume under tort law, suing for attorneys' fees is customary.
Typically, for contract law cases, there must be provisions in the contract for plaintiff attorneys' fees.
I don't think Nevius will have a problem lasting the defendants out since this is a contingency fee case for him: his lawyers collect fees only if they win.
Which means his lawyers think Nevius has a strong case.
Looks like Francis and O'Neal will be paying Nevius' attorneys' fees.
MOTY, they really only have to prove FF's failing health, which shouldn't be hard.

But I think the court will view the 2009 'Appointment' document as moot due to the provisions in the 2008 SBR agreement, as Nevius argues in the complaint.

ReplyDeleteThey have to prove she was not mentally competent at the time it was signed; which really isn't as easy as it sounds. Even with the footage that aired, they could say she was given medication to sleep when Red saw her and that when she signed stuff, she was not on medication.
Just being on medication is not being on your death bed necessitating a temporary death bed visit release of Redmond by the courts.

But the argument made by Nevius is the 'Appointment of CEO' is irrelevant since there was no clause in 2008 Agreement to allow it and there were already provisions in the 2008 Agreement for Nevius to run SBR if FF couldn't.
The court will have to interpret the 2008 Agreement and apply any relevant law in determining the true rights of the parties to the lawsuit.
That's what Nevius is asking the court to do.
And I think the court will agree with Nevius.
And agree that Nevius had the sole authority to run SBR when FF couldn't.
ReplyDeleteAC, the world pretty much knew she was dying, especially when we learned of Red's visit in the tabloids. She didn't pass for a few more weeks which is why I used the medication angle.
ReplyDeleteI've said I've been there.. a week prior to my dad passing he would be ok sometimes and others he wouldn't. I figured it was the chemo as he was still able to walk & go to appointments. He knew what day it was, knew he had to be at the Dr those days BUT other things he had no clue, say his social security number. I visited 6 attorneys, each saying we had to prove what we were claiming. The burden is going to fall on Craig.
I've said that Ryan would be crazy to pass the signature off without having video & an attorney present. I don't think he'd be stupid enough not to have video proof.
I wish Craig would post on that blog; I would love to contact him.
btw, the other thing, Alana said Red was exaggerating about Farrah's weight; last I read she was still saying that. Its my opinion that they would have had to show medical proof in order to get Red's visit; so I'd say that Alana is probably lying here.

ReplyDeletePeople say to me: “Congratulations. Are you excited?” But that’s not the right word. I guess I’m more “relieved.” Because when Farrah took a turn for the worse in April, Ryan O’Neal and his business manager banned me from seeing or talking to Farrah ever again.
At the same time, Ryan and Alana Stewart decided it was time for them to come in and “save” the project. And NBC, who had previously been so supportive and promised Farrah that this was her story to tell, supported them 100 percent. I’m sure the network would say otherwise but I believe that it was because they wanted this on the air for May sweeps and didn’t have the star to promote it. So began the “Ryan O’Neal Grieving Widower Press Tour With Special Appearances by Farrah’s Robotic Self-Promoting Best Friend Alana Stewart.”
That was bad enough but then Ryan and Alana did basically the same thing in the documentary itself by inserting those cringe-inducing, self-serving interview sound bytes shot by an unemployed ex-Dateline NBC Producer. I was appalled. But my appall quickly turned to disgust when I saw that Ryan and Alana had secretly shot Redmond (Farrah’s son with Ryan) in chains when he was released from jail for a few hours, under the supervision of two sheriff’s deputies, visiting Farrah—who was unconscious or close to unconscious in her bed. How dare they?
Ryan was not a producer on this program. Alana had refused to sign her co-producer contract because she wanted more money and a better title. Farrah was the boss, and if the boss was unable to function because of a health crisis her authority went automatically to me as per our company’s operating agreement (signed on April 1, 2008).
Ryan didn’t seem to care what any piece of paper said. He demanded that the title of the documentary be changed from A Wing & A Prayer to Farrah’s Story— which, in my opinion, was nothing but a cheap homage to his greatest claim to fame other than dating Farrah: Love Story. Changing the title was also a cruel irony considering if this was really Farrah’s story it would have been broadcast under the original title that Farrah and I chose: A Wing & A Prayer.

Don’t get me wrong, most of the work that Farrah and I did is there.
Like the diary narration that I shot with her in my living room. No one else was present.
It was just her and her diary—and me and my camera.
It’s just that a lot of our other work was interrupted and sloppily clipped short in order to make room for Ryan’s bad reprisal of his Oliver Barrett role and Alana telling us that “needles are painful.”

I can't disagree with the reviewer.
That being said, there were scenes that were cut out completely.
Scenes that dealt with medical information and issues that Farrah wanted to address in order to start a dialogue that could eventually effect change in our health system.
And once again Ms. Stanley nailed it, criticizing the film for what wasn’t there (based on Farrah’s diary narration) and understanding that it was supposed to have been.
She also seemed to distinguish Farrah from Farrah’s Story.
She wrote that “the film isn’t as nearly as brave or as serious-minded as its cancer-stricken subject.”
But the film that Farrah and I were close to completing was as brave and as serious minded as she was.
Because this project was a total reflection of her—and not Ryan O’Neal or Alana Stewart.
And the fact that NBC allowed Ryan and Alana to do what they did, with significant help from an ex, unemployed NBC Dateline producer who Farrah had previously rejected, is still staggering to me.
The rest of the reviews I read were as bad if not worse.
At that point, I really didn’t think my promise to Farrah—of a nomination much less an Emmy—would come true.
But there was one glimmer of hope.
Most of the reviewers appreciated Farrah herself.
Her bravery.

MOTY, her medical condition in April 2009 is a core issue in the case.
ReplyDeleteNevius can subpoena her doctor and depose him about her condition.
The court may have to rule about issues of medical privacy but since her medical condition is a core issue in the case, the court probably will support release of information about her medical condition during the critical time of April 2009.
But there is plenty of anecdotal evidence about her condition from other sources too.
We'll see what happens in court, I guess.

Not if the court agrees with Nevius and provides the Declaratory Relief moved for by Nevius that Nevius was the sole party with authority to run SBR when FF was unable to do so.
The 2009 'Appointment of CEO' scheme would be moot, as it should be, because it easily looks like a scheme to interfere with Nevius' operation of SBR.
Like Nevius said in his Retroality interview: "a piece of paper (the 2008 SBR Agreement) means nothing to Ryan."
The court may help Ryan appreciate the value of that piece of paper with a liability judgment for Nevius' damages.
MOTY, it was Dr. Piro that said at the time, on I guess it was the NBC interview that he was on with Kate Jackson (where Kate bumbled and stumbled and called Nevius 'Devious') in mid-May, that her weight was 101 not 86.

It doesn't take long reading the 'Appointment of CEO' 042009 document with the phony signature that the person who wrote it read the 2008 SBR agreement and tried to concoct a scheme to get around the transfer of Manager Rights and Responsibilities clauses to Nevius to steal control from Nevius.

It was said by lana in print that Redmond made that he was a young man who basicly did not realize just what he was saying in that Farrah was only 86 pounds. Lana took that weight up to 101, or about . Why would a man go and make up 86 pounds to a judge , why not 90 ? I do not think redmond would lie to a judge .Somewhere in Lana's trying to discredit Farrahs son with that weight crap she seems to have proven her need to be in control. We were told so much crap in those last 75 day's of Farrah's life that it will basicly fall onto the medical Dr who was examining her , A Dr, will be the one who will have to have these facts. Lana did not hold Farrah onto a set of weight scales . A medical evaluation will hold a key to the medicines Farrah was on , at the exact time of her signing anything. Craig has very good chances as his body of work in CF is first well done, it shows a very open communication between he and Farrah. Alana might have shot a certain amount of the Farrah's story, yet the key roles were in Germany, Craigs home, and last Farahs home.Lana would have to prove her being in Craigs home, and again why was she their ? I still say it's strange that neither Kate, or Jaclyn were not in Farrah's story. If you can get kates number she loves to chat , and will do so in the early morning hours.

When was the last time Craig was allowed to see Farrah, why were so many cut off ? Greg Lott, and Craig , plus God only knows whom else. Again it was a big TAP OUT !

Only baby picture of me Saturday, March 14, 2009 - at the bottom he says - I get scoped the first week in April. Then I'm done with treatments in the States. I have to go to Germany for about a week in April. There I'll do heat therapy, get UVB blood work and receive the usual doses of vitamin C with minerals, Vitamin D with amino acids, Vitamin B12 drips, and the rest.
Hot therapy Saturday, February 14, 2009 My doctor at The Klinik in German told me yesterday that she wants me to undergo something called “hot therapy” when I get to The Klinik for post-radiation treatment. In the meantime, she said I should continue doing what I’m doing, and start drips with Vitamin C and Vitamin D with minerals on Tuesday.
Until I feel like Brett again Sunday, February 8, 2009 I saw my doctor from The Klinik in Germany yesterday. She's here in LA for a few days. She brought over some good stuff for me to take and it’s already started to work.
Today was my last radiation session; today was a good day Thursday, January 22, 2009 I saw Farrah and Alana Stewart at the doctors’. Farrah's going to go back to Germany for some treatment, too.
Angel Charlie - From what I understand of HIPAA laws, they stay even in death. If this goes to mediation, I doubt records will even come into the picture.
ReplyDeleteLook at Michael Jackson, and I hate bringing him into this discussion. There's one "nurse" that's been talking on Jane Velez Mitchell; I've wondered how she can speak so freely about MJ.. as it should be confidential. Now she's supposedly been subpoenaed.
Everything is assuming a trial will happen. I actually think when you said they would go into mediation, that is more of what will probably happen. It's a different ballgame there as they try to settle verses prove anything.
Im pretty sure Farrah returned to LA at the end of March and landed in the hospital the week of April 5th,but I think she was in the hospital with the hematoma before april 5th or was released april 5th,not 100% sure but I do know she returned to LA the last week in march

Producer: Farrah Fawcett Not Seeking ‘Desperate’ Medical Treatment In Germany - Access Hollywood
Contrary to a report by a British tabloid, Farrah Fawcett did not say her final goodbyes to her loved ones before she headed to Germany for a last ditch medical treatment for her cancer.
While Fawcett is indeed in Germany, it was to shoot portions of her upcoming documentary.
The 62-year-old actress is currently in Germany because she’s filming her documentary and she is there to interview her doctors, Farrah’s documentary producer, Craig Nevius, told Access Hollywood.
According to the UK’s Sunday Mirror, the former “Charlie’s Angels” actress had flown to Germany for an “aggressive experimental treatment in a desperate attempt to live.”
The Mirror also claimed Fawcett dismissed all of her staff before heading abroad.
However, Nevius said although she will be tested by her doctors while she’s there, the story about her preparing to die is not true. He also noted the actress will be headed back to the U.S. soon.
Fawcett was first diagnosed with anal cancer in 2006.

Fawcett's doctor, Lawrence Piro, has now explained the actress had abdominal bleeding and a hematoma (internal sac of blood) she developed after undergoing aggressive alternative cancer treatments in Germany.
According to Piro, the actress is using a wheelchair as she recovers from the procedure because she is in too much pain to walk.
Piro says, "It turned out that the procedure caused a small amount of bleeding in one of the muscles of her abdomen, making a hematoma, which was quite painful. That pain, which was coming from the hematoma, had nothing directly to do with the cancer.
"She remains in good spirits with her usual sense of humor. She's been in great shape her whole life and has an incredible resolve and an incredible resilience."

So Redmond was requesting his death bed visit to the court 4 days prior to the 'Appointment of CEO' document supposedly executed by a 86-pound cancer-stricken person.
MOTY, the court should have powers to release medical information as evidence in the case if it becomes necessary to decide the case.
ReplyDeleteFF's medical condition was for the most part already made public through the actions of the litigant parties in the case as well as her own actions (Farrah's Story).
Like I said, there's already alot of information about her condition already publicized.
And the truth about her condition can be ascertained by sworn testimony of witnesseses about their already public statements.
Also, I don't think they need to delve into it too much to ascertain that she was not in charge of her faculties in March/April 2009, thus triggering the 2008 SBR Agreement clauses regarding Nevius taking control of SBR.
We'll see what happens in court.
Mediation is just the court system trying to get the parties to settle the case before trial and to not burden the court system with the burden of having to hold another trial.
Normally, formal legal documents have witnesses to a signatories signature, such as a notary public.

They are usually the ones with the best coverage of events. I was watching it the other night, they had the kidnapping case on.

A third party mediator attends to try to get the parties to negotiate.
If I were Nevius, and thought I had a strong case, I would probably want to go to trial.

It was done in taste. The second was a 99 interview of Farrah where Greg is refered to , and made a comment. These are reputable magazines, basicly now better than that trashy VANITY FAIR-It clearly stated that Greg would not speak, as he wanted to remain silent in that jungel called hollywood. Then add the rag sheets, it was all their. Did Farrah not realize this, she proofed each interview she personaly granted. I even say tough old MIMI SCHWARTZ TOSSED IT OUT FOR US TO READ. It was Greg's honesty that said Farrah did not want it public. So do you find fault as well with Farrah, why would she being single not want it public. James Orr was enough to show Farrah was still a woman who even though picked dirt in him, she dated his sorry behind. Again why ,what angers you that Greg was the one who admitted Farrah did not want it known. ? Farrah never has stated this on paper as to it being due to Redmond. Why is it a problem , I do count trust as a first, sure. If you look at trust it brought accusations on Greg that have still not been proven. Greg never hidd it here in Texas, they were everywhere. Super Bill Bradley came in the year after Lott and became the starting UT QB.
Lott couldn't accomplish what Super Bill accomplished the year before.
Lott remained a backup QB his sophomore year while Super Bill was the starting QB his sophomore year.
Being a 'star quarterback' is the only thing Lott talks about when talking football in his news stories.

I believe that Greg Lott NEEDS to tell his side of the story, and by doing so, he is NOT going against Farrah's wishes, as some are saying he is. Reasons are as follows:
ReplyDeleteFarrah no longer has a voice! ... OBVIOUSLY ... Ryan, Alana and who knows who else is saying a lot of shit. Greg KNOWS what is going down, and he NEEDS TO DISCREDIT these rumors and false stories! By doing so, he has to go against Farrah's wishes in order to SET THE RECORD STRAIGHT! He did honor Farrah's wishes while she was still alive, yet because she is now dead, her 'feelings' can't get hurt, and I'm sure she'd want him to spill the truth in order to STOP the money makers using her name! Redmond can't really be hurt by this, because as he knows, he's parents were never officially together. Ryan cheated and did so many other shit to make Redmond embarrassed, so whatever his mother did, shouldn't matter. He knows his mother had relationships with other men BESIDES his father, so I doubt this issue means anything to him. I'm sure Red knows, as the whole word, that Farrah had a relationship with James Orr. So why not the world knowing about Farrah and Greg??
Greg's relationship with Farrah is HIS business, as well. It is part of HIS history. If he feels he wants to speak about HIS business, why not? That is his choice and option! Greg isn't saying anything NASTY or in BAD TASTE with regards to Farrah. So he made some letter's publicly known. I don't see a problem with that. He only did it, I assume, to SHOW PROOF!
I'm only disappointed that Greg cancelled his intentions of writing his own book. Maybe he'll reconsider.

ReplyDeleteAs Far as I'm concerned and I am a neutral party here.. so far Craig is the only one doing justice to Farrah - not Ryan, not Alana & not Greg.
As a neutral party, yes I hated the wheelchair pics BUT I felt it was included in what was shown as Farrah's Story for the fans to see the bigger picture and how invasive the tabloids were. Who ever called them in the 1st place has to live with that and the karma that comes from it.
With what I've been reading from Craig & Greg; I as a viewer have mixed emotions about what I was shown. I know the real story of cancer; I will be living it again. This version that was shown gave us a little bit of everything, the good, the bad and some of the medicine. I hope Red or Craig or both together will consider allowing us to see what FARRAH wanted. Yes I would watch it even after seeing "Farrah's Story". If we do not get to see it, I'm hopeful that Brett's movie will give us the message. I'm hopeful there, the more I read/watch with Brett, the better I am feeling for our situation.
As the loved one of someone that fought and passed; it's the good times through the tears that I like to cherish... Thanksgiving, Christmas & a special day I planned for my dad with many of his friends. My dad was in the hospital, the morning of the event I did not know if the doctors would allow me taking him out; but they did. I walked into his room with his clothes and told him to get dressed we're leaving for a few hours. We didn't do any fancy trips; but the stupid little things in every day life were made to count because we knew we probably wouldn't get another.
This is what I saw with Farrah's Story that was shown.. I as a viewer didn't see it as Farrah & Ryan's "Love Story"; it was Farrah & her fight with cancer.
Had I had a camera; what would I have shown? Honestly, I don't know.
As far as Greg Lott & his "football career" who gives a crap? Obviously he wasn't a star and there are stories to back that up. He played football.. can we move on from this? I honestly don't recall who referred to him as a star 1st, one of the blogs or TBoy.. it's over. Let's end that.

I think Lana did. Melenie Has her own money and her sexy husband is very rich. She's just nuts. Lana is shrewd and cold and that's her style,lana made a career from being a snake. So Im sure she stole from FF,Melanie I doubt,she seems nice but a little off

ReplyDeleteSO, if we are all commenting on the WHEELCHAIR pics/filming of it, LETS BE smart here and realize, FARRAH KNEW she was being filmed in the wheelchair, by ALANA ! AGAIN, At that point she was VERY AWARE Alana was filming. So my opinion on that is FARRAH HERSELF planned to use that footage in the show, what i think FARRAH didnt want was the paps getting that footage, i think she was smart enough to know the value of it for her own STORY ! Its a sin to blame Alana for this when Farrah was ALERT during the scene.

Theres alot of sides here, pro Alana & Ryan, pro Greg & who ever - end of the day everyone should just be pro FARRAH ! I am glad Alana wrote a book, it gives me more Farrah, if Greg wrote a book i would feel the same, wether or not i believe either of them.
